These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with www.visionsaddlery.com website (the "Service") operated by Vision Saddlery, aka 7788568 Canada Inc. ("us", "we", or "our").
Please read these Terms and Conditions carefully before using the Service. Your access to and use of the Service is based on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these terms and conditions, in whole or in part, please do not use the Service.
Purchases
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected. We will not be held responsible or liable for any failure for the Purchase to complete, or any resulting loss or damages to you. Vision Saddlery, aka 7788568 Canada Inc., its representatives and/or its employees make no claim with regards to adequacy or reliability of any products or descriptions within this web site. Products are used at users or purchasers own risk.
By checking this box and completing my purchase, I acknowledge and agree to the following:
I understand and acknowledge that horseback riding, handling horses, and the use of equestrian equipment involve inherent and significant risks, including but not limited to serious personal injury, permanent disability, death, and property damage. I further acknowledge that no equipment, safety product, or pharmaceutical can eliminate these risks entirely.
I confirm that I am solely responsible for:
- Selecting appropriate products for my intended use
- Ensuring proper fit, installation, adjustment, maintenance, and inspection of all equipment
- Using all products strictly in accordance with manufacturer instructions and applicable safety standards
- Determining my own suitability, skill level, and physical ability to use any product purchased
To the fullest extent permitted by law, I voluntarily assume all risks associated with the use, misuse, or failure of any equipment, tack, safety gear, supplements, pharmaceuticals, or other products purchased from 7788568 Canada Inc operating as Vision Saddlery, whether used by myself or any third party.
I hereby release, waive, and discharge 7788568 Canada Inc operating as Vision Saddlery, its owners, employees, agents, representatives, and affiliates from any and all liability, claims, demands, causes of action, or damages of any kind arising from or related to:
- The purchase, use, misuse, or inability to use any product
- Improper fitting, maintenance, storage, or modification of products
- Failure to wear appropriate safety equipment (including helmets)
- Accidents, injuries, or losses occurring during equestrian or animal-related activities
This release applies to claims based on negligence, product use, warnings provided or not provided, or any other legal theory, except where liability cannot be excluded by law.
I acknowledge that I have read and understood this agreement, and I accept it freely and voluntarily as a condition of completing my purchase.
Availability, Errors and Inaccuracies
In order to provide exceptional service, and accuracy, we regularly update the products and services on the Service.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. Example: Sometimes leather can change color after oiling, sometimes the pictures on our site may show an oiled color or unoiled. Sometimes a manufactorer will change a label without providing us with a new image, in this case the product is the same that is being sent out even though the lables are being changed etc.
Despite our best efforts, the products or services available on our Service may have an error regarding the price, be inaccurately described, or be unavailable.
We may experience delays in updating information on the Service and in our advertising on other websites.
Since we do allow saddle trials it is possible our new and demo saddles can have some slight marking from trials. Slight wear marks/rubs can show where the girth does up on the billets, where the billet gaurd and girth buckles/ girth can rub in between flaps and where the riding boot/ stirrup leather sits and rubs on the outside flap. Stitching color can also be darkened by the stirrup leather/ riding boots on the outsode of the flaps. This is all very minor wear and does not make the saddles used, we mark used saddles as either consignment or used in listings. As fit is important with saddles for the horses health and well being we will always allow trials to our clients. Hence all of our saddles new and demos can possibly have slight marks, darkening of stiching from these trials but are considered new.
Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply. Promotions may be available for a limited time.
Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
DUE TO AN INCREASE IN RUDE, HARRASSING, UNRULY, AGGRESSIVE AND ABUSIVE BEHAVIOR WE ARE SEEING AIMED AT OUR STAFF THROUGH EMAIL, PHONE, TEXT, IN PERSON AND ONLINE MESSAGING WE HAVE A ONE STRIKE POLICY. ANY CUSTOMER EXHIBITING ANY OF THE ABOVE BEHAVIOUR WILL BE BANNED FROM SHOPPING AT VISION SADDLERY FOR LIFE WITH ALL PRIVLEDGES REVOKED AND ALL ASSOCIATED ACCOUNTS WILL BE CLOSED (VISON POINTS ETC) RIGHT AWAY. THE AUTHORTIES WILL ALSO BE NOTIFIED IF WE DEEM THE SITUATION TO NEED THIER INVOLVMENT.
Intellectual Property
The Service and all contents, including but not limited to text, images, graphics or code are the property of Vision Saddlery and are protected by copyright, trademarks, database and other intellectual property rights. You may display and copy, download or print portions of the material from the different areas of the Service only for your own non-commercial use, or to place an order with Vision Saddlery. Any other use is strictly prohibited and may violate copyright, trademark and other laws.
These Terms do not grant you a license to use any trademark of Vision Saddlery or its affiliates. You further agree not to use, change or delete any proprietary notices from materials downloaded from the Service.
Links To Other Web Sites
The Service may contain links to third-party web sites or services that are not owned or controlled by Vision Saddlery.
Vision Saddlery has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Vision Saddlery shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.
All provisions of the Terms shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
Indemnification
You agree to indemnify, defend and hold harmless Vision Saddlery, its principals, officers, directors, representatives, employees, contractors, licensors, licensees, suppliers and agents, from and against any claims, losses, damages, losses, obligations, costs, actions or demands.
These include but are not limited to: (a) legal and accounting fees resulting from your use of the Service; (b) your breach of any of these Terms; (c) anything you post on or upload to the Service; and (d) any activity related to your account. This includes any negligent or illegal conduct by you, any person or entity accessing the Service using your account whether such access is obtained via fraudulent or illegal means.
Limitation Of Liability
Vision Saddlery, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any loss or damage, direct or indirect, incidental, special, consequential or punitive damages, including without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, resulting from (i) your access to or use of the Service; (ii) your inability to access or use the Service; (iii) any conduct or content of any third-party on or related to the Service; (iiv) any content obtained from or through the Service; and (v) the unauthorized access to, use of or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other claim in law, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Disclaimer And Non-Waiver of Rights
Vision Saddlery makes no guarantees, representations or warranties of any kind as regards the website and associated technology. Any purportedly applicable warranties, terms and conditions are excluded, to the fullest extent permitted by law. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance, except as provided for under the laws of any province in Canada. In such cases, the provincial law shall apply to the extent necessary. Vision Saddlery its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
If you breach any of these Terms and Vision Saddlery chooses not to immediately act, or chooses not to act at all, Vision Saddlery will still be entitled to all rights and remedies at any later date, or in any other situation, where you breach these Terms. Vision Saddlery does not waive any of its rights. Vision Saddlery shall not be responsible for any purported breach of these Terms caused by circumstances beyond its control. A person who is not a party to these Terms shall have no rights of enforcement.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
Exclusions
As set out, above, some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. Provincial laws of Canada may apply to certain products and service provided.
Governing Law
These Terms shall be governed by, and interpreted and enforced in accordance with, the laws in the Province of Ontario and the laws of Canada, as applicable.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms will remain in effect.
These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements, oral or otherwise, regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
Returns
We know that sometimes even the most perfect things don't quite work out! That's why we are happy to process returns/exchanges for our customers. We are located in Ottawa, Ontario, Canada.
Items are eligible for a FULL REFUND within 14 days of purchase. For online orders this begins the date your package is recorded as delivered by the postal carrier. Items MUST be in their original/unused condition, with original tags, in undamaged packaging with proof of purchase.
Customers will be refunded to their original payment method for the full amount paid (less shipping charges) and also excluding any extra shipping charges that were paid such as express shipping fees. This encompasses orders that an incorrect size/color was ordered etc. Return shipping expenses will not be reimbursed.
If the item is being returned due to being defective, or an item was sent mistakenly by our team, a full refund will be issued (including all shipping costs) with a return shipping label provided at our cost.
Should an item be returned to us and original packaging is absent or damaged, a re-stocking fee of 20% will be applied to the return if we deem it returnable at all.
Once a refund for an online order is started by us it may take up to 48 hours for clients to recieve the refund email notification due to proccessing times by Shopify. Once this email is recived the refund typically takes 5-7 business days to be seen back in your account. Due to varying processing times at clients banks, it might take up to 10 business days for the refunded amount to be received but can also be quicker than 5-7 busniess days.
*Note* Saddle purchases in store or online are not considered saddle trials and cannot be turned into a saddle trial. Saddle trials can only be competed with applicable paperwork in person or on the phone if not in store. A saddle trial has to be specifically set up with a staff member at Vision Saddlery.
Any orders cancelled before shipping due to any reason other than a stock issue will incur a 5% restocking fee of subtotal price before tax. This covers fees incurred to Vision Saddlery by the payment provider which are non refundable.
For Christmas presenst we extend our policy to 30 days after the date of purcahse. Please add a note to your order on the checkout page to inform us if you can! If you need more time than this please let us know either by email or make a note on your order as well.
RETURN FAQ’s
If I have to ship it back, do I pay shipping?
In the rare event we have shipped you the wrong product or it is defective, we will be more than happy to pay for the shipping back to us. If however the product is being returned or exchanged due to improper fit, or the customer simply no longer wants the product, the shipping needs to be paid by the customer.
Do I get a full refund?
With proof of purchase, we offer full refunds for the products' purchase price when the item is returned in the same condition it left the store with all original tags still attached and if shipped in a box, the box in original condition as well and not damaged or taped (example helmet, boots etc), within 14 days of purchase. Product that comes in packaging (box, container) must be returned inside another box as not to damage the packaging. If a product is returned not in original condition or with damaged packaging, we reserve the right to either not refund or partially refund the item or charge a 20% re-stocking fee due to violation of our policy. Refunds for purchases made through our website online can take 2-10 days to go back into your account once processed.
How long do I have to return something?
We offer a 14 day full money back return with proof of purchase on all products in new condition. For online orders, the 14 day period begins upon delivery of your shipment.
*Note* Saddle sales in store or online are not saddle trials and cannot be turned into a saddle trial. Saddle trials are only done with a staff member either in person or on the phone if not in store. A saddle sale is not a saddle trial a trial has to be specifically set up with a staff member at Vision Saddlery, using the applicable paperwork.
STORE CREDIT/EXCHANGE
Items are eligible for STORE CREDIT/EXCHANGE within 30 days of purchase. For online orders this begins the date your package is recorded as delivered by the postal carrier. Items MUST be in their original condition, with original tags AND packaging. In-store credits will be issued for the full amount paid EXCLUDING any shipping charges that were paid by the customer or applicable re-stocking fees. Return shipping expenses will not be reimbursed.
After 30 days we cannot issue an exchange/in-store credit.
We do not offer refunds/returns/exchanges or in-store credits on the following:

WARRANTIES
Vision Saddlery sells products manufactured by third-party brands. Any warranties, guarantees, or representations relating to those products are provided solely by the original manufacturer and not by Vision Saddlery. Vision Saddlery does not offer, extend, or administer warranties on products manufactured by other companies, even if those products are purchased through Vision Saddlery.
At a customer’s request, Vision Saddlery may contact the manufacturer on the customer’s behalf to assist with a warranty inquiry or claim. However, Vision Saddlery makes no guarantees regarding warranty approval, replacement, repair, or outcome, as all warranty decisions are made exclusively by the manufacturer and are subject to the manufacturer’s terms and conditions.
Vision Saddlery shall not be held responsible or liable for any denial of warranty, delays, or determinations made by third-party manufacturers.
SADDLE RETURNS
Saddles purchased in store are returnable within 14 days of purchase in new condition with original tags and proof of purchase with no restocking fees provided they are being returned in the same condition. Saddles purchased online or by phone and shipped within Canada or to the USA will have a restocking fee of 20% of the regular sale price of the saddle and must be in original condition with tags and receipt. Used and consignment saddles fall under the same policy and must be in the same condition as sent out in.

Saddle Trials
We do not offer saddle trials outside of Canada due to Customs/ Duty issues.
For online/shipped saddle trials, all saddles are sold on a 7 day trial with a credit card hold processed for the amount of the saddle price plus applicable tax/shipping. The 7 days begins when you get the saddle home and ends when (if) you put it in the mail to ship it back to us. The saddle must be returned it in the same condition it went out in for a full refund. Shipping is paid both ways by the customer for trial saddles. The credit card hold will be taken off after the saddle is retuned if not purchased.
For in-store pick up saddle trials, all saddles are signed out on a 7 day trial with credit card hold for the amount of the saddle plus applicable taxes/shipping. The 7 days begins when you pick up the saddle, and ends when it is returned to the store. The hold on your credit card is then released once we have the saddle back in the same condition as it went out at the beginning of the trial if the saddle is not purchased.

Due to the ongoing instability in the current US Governments decision making processes and yo-yoing policies on trade tarriffs. We, unfortunately have to write the following statements and warnings for our amazing US based clientelle. We possibly may have to also stop shipping to the US depending on what happens with the current US administarions decision making. We truly hope this is doesn't happen and is the tarriff issue is resolved quickly!
*We cannot ship to USA P.O Boxes

- Tariffs on Chinese Goods:
- The U.S. now imposes a 10%-50% tariff on all Chinese goods and this may apply to your purchase
- All Shipments to the US may require formal customs entry and may face additional duties.
- Carrier Brokerage & Fees:
- Due to the increased and new 25% tariffs imposed by the US government shipments will be looked at closer and will be scrutinized more regularly by customs etc. Customers may be charged brokerage fees by the shipping company and or higher fees associated with their orders until the tariffs are hopefully relaxed again. We are not aware of what these fees are or their amounts at the time being. Any shipment or tarriff fees incurred to us from refused or shipments with changed delivery locatons and sent back to Vision Saddlery by the customer will be taken out of any refund amount.
*Due to the latest Canada Post Strike we cannot ship to P.O. Boxes in Canada at this time and we will not be using Canada Post for deliveries for the near future
General Information
We work to ship out orders the same business day or the next business day after the order has been placed. For holidays, Friday afternoons, weekends, and during physical inventory audits, we may take up to 3 business days to ship orders from our store.
To ensure a speedy delivery, your order will be shipped via UPS, Purolator, or CanPar. If
you prefer a specific shipping company, or if your order needs to be shipped to a P.O box or remote address, please reach out and our team will do our best to accommodate your request.
A tracking number will be emailed to you once your order has shipped out. Tracking
updates are available typically within 1 day of shipping out. If your tracking shows that your package has not been delivered and there seems to be an unexplained delay in the delivery, please feel free to contact us and we would be happy to help you.
If you wish to reship an unclaimed, refused, or undelivered package you are responsible for the new shipping cost.
We are not responsible for lost, mis delivered, or stolen packages, or packages that we've resent to the address that was entered in at checkout that the customer failed to correct. If your tracking shows that your package has been delivered, please check with neighbours and family members to make sure they did not receive it by mistake. Then, feel free to file a claim with the appropriate delivery service. If you have a privacy fence or gate, a note must be placed on the order in regards to the gate/fence so we can have a signature required forthe shipment to ensure its safe delivery. If this is not noted, (privacy gate/fence) we will not be responsible for lost, mis-delivered or stolen packages on the pertaining order.
We are not responsible for return shipping costs when returning items for refund or for lost returns.

North American Shipping Information
Our shipping options for shipping in North America are as follows:
Business days are Monday through Friday only and do not include national holidays.
Free standard shipping to Canada on orders over $125.00 CDN before tax and $19.95 CDN shipping charge for purchases under $125.00 before tax. Estimated standard delivery in Canada is between 3-7 business days. Express option available within Canada for an extra $35.00 CDN for 1-3 days delivery (normally maximum 2 business days). $35.00 CDN standard shipping to USA with estimated delivery within 4-7 business days and express shipping option available for $50.00 CDN with estimated time of 2-3 business days for delivery time. We ship mostly with UPS but do use others like Purolator and Fedex depending on what service works best for the address being shipped to.
*Note all these shipping times are estimated, we cannot guarantee the shipping time due to carrier reasons beyond our control. Business days are weekdays so orders placed on weekends will not ship until Monday's.
International Shipping Information
At this point of time we do not offer shipping outside of North America

*Once an order is with the courier service or Canada Post the order is then out of our hands at Vision Saddlery and we have no control over the company that is shipping it. Will will try our best to help with packages that are delayed in shipping or not updating to the best of our abilites but cannot gaurantee delivery within our suggesed shipping times or at all for any shipment as sometimes there can be issues. Even though it is extrmely rare it can happen. Also in Holiday seasons (Christmas, Black Friday etc) shipping can be delayed due to the overload to the carriers and couriers.
If an order has a shipping delay or issue please reach out to the company that it has been shipped by with the tracking information for the shipment provided to you. Contact information is below for all the courier services we use. We do not have a lot of spare time to look into shipments with delays, we don't mind to look into them but it can be a two or three day delay sometimes before we are able to call. As we are quite busy with customers, shipments, packing orders, recieving orders etc. Due to this we urge you to reach out to the companies yourself with tracking information.
Any orders from an address that seems to have recurring issues with deliveries will be blocked from future shipping and any orders placed with an address that has recurring issues will be cancelled and refunded.
IF YOU ARE NOT ABLE TO DEAL WITH ANY DELAYS OR ISSUES THAT CAN ARISE, WE URGE YOU TO SHOP SOMEWHERE ELSE. UNFORTUNATELY THE WORLD IS NOT PERFECT SO ISSUES CAN HAPPEN AND WE WILL NOT DEAL WITH HARRASSING BEHAVIOUS OVER SHIPPING DELAYS WHICH AGAIN ARE CPMPLETELY OUT OF OUR CONTROL.
WE RESERVE THE RIGHT TO CANCEL AND REFUND ANY ORDERS EVEN IF SHIPPED AND HAVE THEM RETURNED TO SENDER IF WE FEEL THAT WE ARE BEING HARRASED IN ANY WAY OR FORM IN REGARDS TO SAID ORDERS THAT ARE DELAYED NOT DUE TO ANY FAULT OF VISION SADDLERY. ANYONE WITH UNRULY OR HARRASSING BEHAVIOURS OF ANY KIND WILL BE BANNED AND BLOCKED FROM ALL CONTACT WITH VISION SADDLERY FOR EVER.
